What Is VC 14601.2? Driving on a DUI-Suspended License, Explained

Vehicle Code 14601.2 is driving while your license is suspended for a DUI — a step up from ordinary suspended-license driving (VC 14601.1).

A first offense is a misdemeanor with a mandatory minimum of 10 days in county jail — which is why the knowledge defense matters so much.

What VC 14601.2 Says

VC 14601.2 applies specifically when the license was suspended or revoked for a DUI (Vehicle Code 23152 or 23153), and the person drove with knowledge of the suspension. As with the general statute, knowledge is presumed if the DMV mailed notice — a presumption that can be challenged.

The Mandatory Minimum

This is what sets it apart. A first conviction carries imprisonment in county jail for not less than 10 days nor more than six months, and a fine of $300 to $1,000. Unlike ordinary suspended-license driving, the 10-day minimum is built into the statute — making a dismissal or a reduction to a lesser charge especially valuable.

Defenses

  • No knowledge of the suspension — the DMV notice never reached you (a wrong or old address).
  • You were not driving, or the license was not actually suspended for a DUI.
  • Reinstatement. Clearing the underlying suspension and getting relicensed often drives a much better disposition — sometimes a reduction to VC 14601.1 or an infraction.
