Missing a court date in California triggers a bench warrant for your arrest — and can add a new failure-to-appear charge on top of your case.

The good news: a lawyer can usually get the warrant recalled and the case back on track, often without you spending time in custody.

What a Bench Warrant Does

When you miss a required appearance, the judge issues a bench warrant authorizing your arrest. It can lead to being taken into custody on any later contact with police — a traffic stop, an airport, a routine encounter — and it can put a hold on your driver’s license.

The Failure-to-Appear Charge

Missing court can also be charged as a separate crime — failure to appear — under the Vehicle Code or Penal Code, depending on the underlying case. That is a second problem stacked on the first, which is why acting quickly matters.

How to Clear It
