Penal Code 243.4(e)(1) is misdemeanor sexual battery: touching an intimate part of another person against their will, for the purpose of sexual arousal, gratification, or abuse.

It is a misdemeanor (up to six months, $2,000 fine) — but it requires sex-offender registration under PC 290.

What PC 243.4(e)(1) Says

The misdemeanor form requires (1) a touching of an intimate part of another person; (2) against that person’s will; (3) for the specific purpose of sexual arousal, gratification, or abuse. Felony sexual battery (other subdivisions) requires aggravating facts such as unlawful restraint. The misdemeanor turns on consent and intent.

Penalties and Registration

Misdemeanor sexual battery is punishable by up to six months in county jail and/or a $2,000 fine — but the sentence is rarely the real stake. A conviction requires registration as a sex offender under PC 290. That is why the central goal is frequently to avoid a PC 243.4 conviction, including by negotiating to a non-registerable offense.

Defenses

  • Consent. A touching the other person agreed to is not sexual battery.
  • No sexual intent. An accidental or non-sexual touching does not meet the specific-intent element.
  • No touching of an intimate part, or the contact did not occur as alleged.
  • False or mistaken accusation. Given the registration stakes, resolving the case as a non-registerable offense is often the goal.
