Criminal defense attorney fees in San Francisco range from $2,000 to $15,000+ for misdemeanor cases, depending on the charge, case complexity, and attorney experience. Most attorneys charge either a flat fee or an hourly rate ($250–$500/hour). At ASH Legal, I offer flat-fee misdemeanor defense starting at $2,800 — covering everything from arraignment through resolution with no hourly billing and no surprise invoices.
What Do San Francisco Criminal Defense Lawyers Charge?
Typical Fee Ranges by Charge Type (Misdemeanor)
These ranges reflect typical San Francisco private attorney fees for 2026. Actual fees vary by attorney and case specifics.
Flat Fee vs. Hourly Rate: Which Is Better?
Flat fee means you pay one agreed-upon amount that covers the entire case. Every pre-trial court appearance, motion, phone call, and email is included. You know the cost before you start.
Hourly rate means you pay for every unit of time your attorney spends on your case — typically $250–$500/hour in San Francisco. The total is unpredictable, and every phone call adds to the bill. An attorney billing hourly has a financial incentive to stretch out the case.
For misdemeanor defense, a flat fee is almost always better. It gives you cost certainty during an already stressful situation and aligns your attorney's interests with yours: resolve the case efficiently and favorably.
What Does the Fee Include at ASH Legal?
All pre-trial court appearances — arraignment through resolution. In many misdemeanor cases, your attorney can appear on your behalf so you don’t miss work.
All motions — suppression, dismissal, discovery motions, and any other pre-trial motions relevant to your case.
Plea negotiation — negotiating with the DA for charge reduction, diversion, or dismissal.
DMV hearing (DUI cases) — requesting and representing you at the Administrative Per Se hearing.
Direct communication — you talk to Ahmed, not a receptionist. Phone, email, and text. Case updates when they matter.
Investigation — reviewing police reports, body camera footage, witness statements, and lab results.
Is a Public Defender Free?
Yes. The San Francisco Public Defender's office provides free representation to anyone who qualifies financially. Public defenders are experienced attorneys — some of the best trial lawyers in the city work in that office.
The tradeoff is caseload. SF misdemeanor deputy PDs reported active caseloads of 100 to 150 cases each in April 2026. A private attorney gives you individual attention, proactive investigation, and more time dedicated specifically to your case. If you have the means to hire a private attorney, the difference in attention can be significant.
The True Cost of Not Hiring a Lawyer
A misdemeanor conviction costs far more than attorney fees. Consider the total financial impact:
A $2,800 flat fee to avoid a conviction that costs $15,000+ in downstream consequences is not an expense. It's a bargain.
