What Is a 'Wet Reckless' (VC 23103.5)?

By Ahmed S. Hasan·San Francisco Criminal Defense Attorney·Bar #364992

A “wet reckless” (Vehicle Code 23103.5) is a reduced plea from a DUI to reckless driving involving alcohol.

It is the most common favorable outcome on a first-offense DUI when the case has weaknesses — and it carries meaningfully lighter consequences.

What a Wet Reckless Is

A wet reckless is not a separate charge you get arrested for — it is a negotiated reduction. You plead to reckless driving (VC 23103), and the record notes that alcohol was involved (which is why it is called ‘wet’). It becomes a priorable offense for a future DUI, but it is a real step down.

Why It's Better Than a DUI

Compared to a DUI, a wet reckless typically carries lighter penalties, shorter probation, a shorter (or no) alcohol program, and reduced license consequences. It also does not carry the mandatory license suspension that a DUI conviction does, and it looks materially better on a record.

When It's Available

Prosecutors offer a wet reckless when the case has weaknesses — a borderline blood-alcohol concentration (near 0.08%), a questionable stop, or problems with the chemical test. Building those weaknesses is exactly the defense work that earns the reduction. Note that standard judicial diversion (PC 1001.95) is not available for DUIs. See how to beat a DUI.
